Description: As required under the federal Every Students Succeeds Act (ESSA) and established in the state ESSA plan, Louisiana will include a measure of progress to English language proficiency for English learners in the Assessment Index of the accountability formula.

Over a six-month period, a working group of Louisiana experts in English learner instruction, including schools and school systems serving a majority of English learners, guided the creation of the measures. The Louisiana Accountability Commission unanimously endorsed the working group recommendations on August 20, 2018. The revisions to Bulletin 111, 
The Louisiana School, District, and State Accountability System,  are as follows:
  1. A letter grade of ‘A’ represents that students are on track to reach English language proficiency within five to seven years, as supported by research and national best practice; and
  2. Due to the state transition to a new English language proficiency assessment during the 2017-2018 school year, the 2018-2019 school year will be a learning year in which results are calculated and provided to schools but not yet part of the final results. English language proficiency progress will be included in the accountability formula no earlier than the 2019-2020 school year.

Description: The proposed revisions establish a new rating formula for alternative education (AE) schools that is more closely aligned to the unique mission of serving students referred to AE for long-term services. For AE elementary and middle schools, the proposed formula is based 100 percent on state assessment progress, and for AE high schools, the formula is based on 25 percent of each of the following: state assessment progress; current year core credit accumulation; second-year dropout/credit accumulation: and credential attainment.

Inclusive but not limited to AE, is a proposed revision to the maximum number of students (accountability “units”) required for a school to receive a school performance score (SPS) and school letter grade. Current policy requires a minimum of 10 students or 40 accountability units, which leads to several extremely small schools receiving an SPS and school letter grade in some years, but not in others, as small school enrollment fluctuates. ESSA allows states to set a threshold of 30 students or 120 accountability units, which recognizes the challenges of reporting performance for extremely small sites and provides for greater stability over time. The LDE recommends the use of 30 students or 120 accountability units, which federal law allows and several other states use, for assignment of an SPS and school letter grade. Sixteen schools, providing alternative education and/or serving residential students with significant cognitive disabilities, had fewer than 30 students included in accountability calculations. Student scores and subgroup performance will continue to be reported with a minimum of 10 students, and schools with less than 30 students will continue to be identified for improvement and eligible to apply for improvement funds.

To assist school systems with implementation of the new AE model, the LDE will provide LEAs with the following redesign resources and strategies:
  • Schools with high rates of out-of-school referrals labeled as “Urgent Intervention Required” may apply for ESSA school improvement funding; and
  • AE schools with comparatively low student performance labeled as “Comprehensive Intervention Required” may apply for ESSA school improvement funding.

The LDE will assist both groups of schools with a behavioral intervention vendor guide, lists of evidence-based interventions, lists of evidence-based curricula, and opportunities for ongoing face-to-face professional learning.

Description: Act 392 of the 2017 Regular Legislative Session requires BESE, in consultation with the Louisiana Science, Technology, Engineering, and Mathematics (LaSTEM) Advisory Council, to establish STEM diploma endorsements recognizing high school students who exhibit academic achievement in STEM discipline subjects.

Proposed revisions establish two STEM diploma endorsements beginning with the 2018-2019 school year:
  1. Advanced STEM Endorsement (Gold Seal)—awarded to students who successfully complete a BESE-approved Jump Start STEM Pathway eight STEM-course sequence; and
  2. STEM Endorsement (Silver Seal)—awarded to students who successfully complete a subset of required courses, to be designated by the LDE, within a BESE-approved Jump Start STEM Pathway four STEM-course sequence.

Description: The LEAP 2025 United States History assessment was administered for the first time during the 2017-2018 school year. Educator stakeholder committees including teachers, principals, superintendents, chief academic officers, etc. were involved in each step of the development process prior to the first operational administration of this new assessment. Also, Educator committees review student performance following test administration, continue to review achievement throughout the process of standard setting, and recommend the attached performance level cut scores to BESE. The proposed policy revisions:
  • Clarify policy regarding assessments and results; and
  • Outline performance level cut scores for the LEAP 2025 United States History End of Course assessment.

In addition, revisions to Bulletin 118, Statewide Assessment Standards and Practices, align policy with recent state legislation and currently proposed policy changes. These revisions include:

  • Requiring the department to provide assessment results for each student who is administered the standards-based assessments in English language arts and mathematics to each public school governing authority no later than June 30 each year (Act 517 of the 2018 Regular Legislative Session).
Note: Among these revisions, the Board adopted as a Declaration of Emergency, the revisions to sections 5701, 6803, and 6813, effective August 15, 2018, for a period of 120 days from adoption or until finally adopted as Rule.

Description: In October 2017, BESE adopted revisions to Bulletin 1566 requiring the following of Local Education Agencies (LEAs), beginning with the end of the 2017-2018 school year and at the end of each school year thereafter:

Continuing students entering grades 3-8:
  • Identify third and fourth grade students who have scored below “basic” achievement level in a minimum of two core academic subjects, including English language arts (ELA), mathematics, science, and social studies; and
  • Determine promotion decisions for fourth grade students based on a preponderance of evidence of student achievement; however, whether promoted or retained, students not meeting minimum academic expectations will be provided with an individual academic improvement plan. The plan must remain in effect until such time as the student performance in identified subjects increases to the basic achievement level.

Continuing students entering grade 9:

  • Eighth grade students must score at least at the “basic” achievement level in either ELA or mathematics and “approaching basic” in the other subject in order to be promoted to the ninth grade; however, students not meeting the promotion standard after taking the eighth grade state assessments may be placed on a high school campus in transitional ninth grade.

The proposed revisions to Bulletin 1566 relate to student placement in first grade and the transfer of students from out-of-state schools, non-public schools, and home study programs. The revisions outline:

  • Prerequisites to enrollment in first grade; and
  • Requirements for students transferring into public schools seeking to enroll in fifth and ninth grade. These students must take and pass the ELA and mathematics portions of the LEAP placement test.

Several LEAs have since requested to be able to address placement and promotion for transfer students in the same manner in which addressed for continuing public school students, and to be able to do so beginning with the 2018-2019 school year.

Description: Educational Testing Services (ETS) has released an updated version of the Praxis exam for school leaders, the School Leaders Licensure Assessment (6990). This exam will be available effective September 1, 2019, and will replace the current School Leaders Licensure Assessment (6011). The 6011 exam will no longer be offered effective August 31, 2019.

The key changes to the new 6990 exam include:

  • Reduce number of constructive response items from 7 to 4;

  • Increase time to take the new test from 120 minutes to 165 minutes;

  • Add Climate and Cultural Leadership section with 22 questions; and

  • Remove the Education System section.

ETS conducted a multi state standard-setting study in January 2018. The LDE further recommends adoption of the nationally-recommended cut score for the 6990 exam of 151.

In December 2017, the Louisiana State Association of School Personnel Administrators (LSASPA) submitted recommendations to the Board of Elementary and Secondary Education (BESE) and  to the Louisiana Department of Education (LDE) regarding policy shifts to address teacher workforce needs.


In June 2018, BESE approved certification policy updates that addressed certain policy recommendations. Following the meeting, representatives from BESE, LSASPA, the Louisana Association of School Superintendents (LASS), and the Louisiana Association of Colleges of Teacher Education (LACTE) met to review the LSASPA recommendations relative to mathematics. The following proposed revisions were developed at that meeting:

  • Requires applicants to pass the Middle School Mathematics PRAXIS (5169) and the Principals of Learning and Teaching PRAXIS Exam (Grades 7-12);

Description: BESE directed the Louisiana Department of Education to create a mechanism for school systems wishing to appeal test security decisions by the LDE. The policy revisions address the following:
  1. School systems are no longer required to investigate every void; however, school systems wishing to contest a void must submit a request in writing, including a report resulting from an investigation pursuant to Bulletin 118 §5305.A.3.
  2. Appeals will be heard annually, at a public meeting, by the test irregularity review committee. The committee will consist of the following members:
    • LDE Director of Assessment or his/her designee;
    • a degreed, experienced large-scale assessment psychometrician;

Description: In June 2017, BESE charged the Teacher Certification Appeals Council (TCAC) with making recommendations relative to the Temporary Authority to Teach (TAT) certificate so that school systems are better able to meet workforce needs.

In spring 2018, BESE and the Louisiana Department of Education (LDE) solicited stakeholder feedback from the Louisiana State Association of School Personnel Administrators (LSASPA) and school systems regarding certification policy shifts to address teacher workforce needs, specifically for mathematics and for teachers serving students with special needs.

Additionally, Act 411 of the 2018 Regular Legislative Session calls for the development of a certificate specific to teachers serving students with dyslexia. In response, as well as to reconcile certain certification requirements with state law, the Board approved the following revisions to Bulletin 746:

  1. Revisions regarding the Temporary Authority to Teach (TAT) certificate:
  • The Temporary Authority to Teach becomes a renewable certificate for up to three years, provided the educator receives effective ratings and is teaching in a demonstrated area of need. Further, the Teacher Certification Appeals Council may consider appeals relative to the TAT Certificate.
  1. Revisions regarding the Math for Professionals certificate:
  • Expand the eligibility criteria for the Math for Professionals certificate to include candidates who earned a master’s degree in engineering. 
  • Change the certificate's renewal terms so that the certificate is valid for three years initially and may be renewed every five years thereafter, provided the educator receives effective ratings pursuant to Bulletin 130, Regulations  for the Evaluation and Assessment of School Personnel.
  1. Revisions to certification areas relative to serving students with special needs:
  • Per Act 411 of the 2018 Regular Legislative Session, establish two ancillary certificate options for teachers serving students with dyslexia:
    • Dyslexia Practitioner Ancillary Certificate, and
    • Dyslexia Therapist Ancillary Certificate.
  • Create add-on endorsements in American Sign Language (ASL) for K-12 and 6-12 allowing certification in ASL as a foreign language by adopting the ASL PRAXIS exam.

  • Add a Provisional Mental Health Professional Counselor Certificate to align with state statute relative to mental health professional certificates.

Description: R.S. 17:24.4 requires that BESE develop state content standards for required subjects to be taught in Louisiana public elementary and secondary schools. State content standards are statements that define what a student should know or be able to accomplish at the end of a specific time period or grade level or at the completion of a course. According to statute, the standards are to represent the knowledge and skills needed for students to successfully transition to postsecondary education and/or the workplace, as determined by content experts, elementary and secondary educators, school leaders, postsecondary education leaders, and business and industry leaders.

In accordance with state law, the LDE met with a diverse group of stakeholders (see chart below) to develop a draft set of aligned standards for students with significant cognitive disabilities to address the identified issues of these students. The majority of respondents to the public comment period believe that the newly-aligned expectations demonstrate the presence of:
  • Aligned expectations for students with significant disabilities,
  • Essential knowledge and skills,
  • Equitable set of mastery standards that provide access to grade-level content,
  • Clear benchmarks for assessing student progress and mastery on the K-12 continuum, and
  • Support increased academic growth and mastery.
Additionally, respondents requested resources for scaffolding instruction and meeting the needs of students at various proficiency levels.

The Science Connectors are pathways for the academic achievement of students with significant cognitive disabilities. The Science Connectors, which are found in Bulletin 127, 
LEAP Connect Assessment, Louisiana Connectors for Students with Significant Cognitive Disabilities, are fully aligned to the Louisiana Student Standards, and ensure equal access to learning is provided to students with disabilities to the extent possible. This alignment is also required by federal law in the Elementary and Secondary Education Act, known as the Every Student Succeeds Act (ESSA).

Description: Bulletin 140 is a set of regulations focused specifically on Early Childhood Community Networks. The bulletin seeks to address three critical needs:
  • Ensure one organization within each local Community Network coordinates across programs (child care, Head Start, school-based Pre-K), and define organization responsibilities;
  • Set clear expectations for implementation of coordinated enrollment as required by Act 717 of the 2014 Regular Legislative Session, and establish processes to ensure fairness and equity for providers and families; and
  • Establish a unified quality rating and improvement system that specifies how programs and Community Networks are evaluated, and establishes processes for fairness and equity for programs.

The unified quality rating and improvement system launched with a Learning Year in 2015-2016. Every publicly-funded early childhood site received a performance profile and every community network received a network performance profile for the first time in 2016-2017. The profiles were released publicly on Louisiana School and Center Finder.

Revisions to Bulletin 140 address challenges identified based on two years of performance data. These revisions help increase access and improve quality by:

  1. Implementing a fifth performance rating called "High Proficient" for sites and networks
    • Nearly two-thirds of programs are rated Proficient yet there are key differences in what children are experiencing at the top and bottom range. Implementing a new rating provides better information to families.
    • Excellent is a high bar that programs may perceive as impossible; creating a rating between Proficient and Excellent encourages incremental improvement.
    • School Readiness Tax Credits already distinguish higher performing Proficient child care sites so the change aligns expectations across program types.
  1. Requiring improvement planning for sites that score low "Approaching Proficient"
    • Data shows these sites are not utilizing resources provided by the Louisiana Department of Education (LDE).
    • By targeting low scoring sites rated "Approaching Proficient" for intervention, the LDE is helping create a pathway to proficiency.
    • The intervention would include improvement planning, targeted resources (e.g. curriculum or mental health consultation), and support for all sites below 3.75, noting that the LDE previously provided intervention for sites rated "Unsatisfactory," resulting in improvement for 11 out of 13 sites.
  2. Aligning early childhood and K-12 definition for “economically disadvantaged”
    • Pre-K programs will use the same "economically disadvantaged" criteria as K-12.
    • As eligibility is regulated federally,  Head Start or CCDF will not be impacted.
  3. Transitioning infant classrooms into the rating and improvement system
    • An infant’s brain more than doubles in size within the first year of life, yet Louisiana does not currently evaluate infant classrooms.
    • Infant teachers will have access to feedback and professional development to support continuous improvement.
    • Changes will be phased in over three years.
  1. Additional policy revisions will:
    • Clarify definitions for lead teacher and classroom experience;
    • Provide more details for disaster considerations for severe impact sites; and
    • Provide more guidance for observing multi-age classrooms.

Description: In Louisiana and across the nation, concern is growing regarding the increase in drug addiction and use of opioids, including among youth. During the past  months, the LDE researched evidence-based programs, specific to opioids, and contacted school health coordinators to better understand the programs presently in use.

To the extent that drug addiction and opioid use are are not currently addressed in Bulletin 741, 
the LDE considered how such instruction might be embedded within school-based programs and support. In response to feedback from the Superintendents Advisory Council, the LDE proposes the attached revisions to Bulletin 741 to ensure an opioid-specific component is included in substance abuse prevention programs. Additional supports, resources, and training will be made available to local school systems during the summer 2018 and integrated into professional development and communication structures beginning with the 2018-2019 school year.

Description: In October 2017, BESE approved, as Notice of Intent, revisions to Bulletin 1566 relative to student promotion, placement, and summer remediation. In December 2017, and in response to stakeholder feedback, BESE approved further revisions to include the following:
  • Revise policy to allow teachers rated “Effective: Proficient,” in addition to those rated “Highly Effective,” to teach summer remediation;
  • Clarify which students shall be provided an individual academic improvement plan; and
  • Delete two remaining references to the summer retest, not included in the October revisions.

At its January 2018 meeting, BESE approved further revisions to summer remediation provisions based on school system feedback:

  • In accordance with state law, continue to offer summer remediation to students who have been identified as academically struggling, but enable LEAs to identify such students based not only on the results of state assessments, but also on a preponderance of evidence of student learning available at the end of the school year; and
  • Remove the requirement that a first-time eighth grade student that does not meet the eighth grade promotion standard complete summer remediation before being placed on a high school campus in transitional ninth grade.

Description: To ensure compliance with the Child Care Development Block Grant final rule, BESE approved revisions to Bulletin 139 to ensure the child care assistant program is federally compliant while meeting the needs of low-income, working families.

Proposed changes include revised definitions, which provide clarity on the practices often investigated by federal and state auditors, and used by quality specialists to assess the integrity of the Child Care Assistance Program (CCAP).

To ensure federal compliance of CCAP, updates include revision of details relative to redetermination of eligibility for child care services, procedures for graduated phased out, and procedures for processing payments for registration fees is proposed.

Description: In October 2017, BESE approved, as Notice of Intent, revisions to Bulletin 1566, Pupil Progression Policies and Procedures, relative to student promotion, placement, and summer remediation. In response to stakeholder feedback, the Board approved further revisions that will:
  • Update Section 103. Preface,  to correspond to revisions throughout the body of the bulletin;
  • Revise policy to allow teachers rated “Effective: Proficient,” in addition to those rated “Highly Effective,” to teach summer remediation;
  • Clarify which students shall be provided an individual academic improvement plan; and
  • Delete two remaining references to the summer retest, not included in the October revisions.
The aforementioned changes are highlighted in the documentation linked to the "proposed change" above, that includes the October 2017 revisions and is presented in its entirety. The action of the Board will supersede the action taken by BESE in October 2017, so that one Notice of Intent will be submitted to the Louisiana Register.

Description: Current policy, per Bulletin 746, Louisiana Standards for State Certification of School Personnel, lists two approved agencies from which the LDE can accept evaluations of foreign credentials for purposes of certification. One of these agencies no longer offers this service, which means that there is only one agency from which the LDE can accept foreign credential evaluations.

The proposed revisions will allow the LDE to accept evaluations of foreign credentials from any agency that follows the evaluation standards promulgated by the American Association of Collegiate Registrars and Admissions Officers (AACRAO).

Description:
 
As Louisiana has implemented more rigorous academic standards over the past few years, BESE and the Louisiana Legislature have enabled Local Education Agencies (LEAs) to make decisions relative to student promotion and remediation, based on a preponderance of evidence of student learning, rather than based solely on LEAP results. Those temporary policies were set to expire beginning with the 2017-2018 school year.

Following a review of student data and extensive stakeholder engagement and in order to support student promotion and support, BESE approved revisions to Bulletin 1566 
as follows:

  • Beginning in 2017-2018, each LEA shall identify, prior to the end of the school year and based on a preponderance of evidence of student learning, third and fourth grade students who are not performing at a level needed to successfully transition to the next grade level in at least two of the four core academic subjects of: English Language Arts (ELA), mathematics, science, or social studies. Students in fourth grade may be promoted or retained, but in either case, shall be provided an Individual Academic Improvement Plan that outlines specific research-based supports and interventions that will be provided in order to address student academic weaknesses. The plan shall remain in effect until such time as the student performance in identified subjects increases to appropriate levels.
  • The LDE shall provide to each LEA, a roster of third and fourth grade students who have scored below the “Basic” achievement level in at least two core academic subjects. Such roster shall assist the LEA in making final determinations relative to individual student academic plans.
  • LEAs shall continue to offer summer remediation to students, pursuant to state law. Participation in summer remediation may serve as one support or intervention to address the student individual academic improvement plan.

Eighth grade promotion policies continue the option to place eligible students in transitional ninth grade.

Description: During the 2017 Regular Legislative Session, the Legislature passed, and the Governor signed into law, House Bill 20 (Act 365) to allow BESE and the state superintendent of education to approve waivers of required instructional minutes for schools that temporarily shared facilities, each holding school for part of the school day, due to the impact of a declared natural disaster or emergency. The law, while passed in 2017, became effective beginning with the 2016-2017 school year. Proposed revisions to Bulletin 741 approved by BESE align policy with current law. Proposed revisions to Bulletin 741 also include language to ensure that, for spring 2018, the decision to include English I, English II, algebra I, and geometry LEAP 2025 assessment scores as a percentage of student final grades shall be determined by local education agencies (LEAs) and shall be outlined in the Pupil Progression Plan.

Actions Related to the Suspension/Denial and Revocation of Louisiana Certificates clarify and update policies relative to certification licensure denial, suspension, and revocation, as well as technical edits. Proposed policy revisions:
    • Define "facilitation of cheating";
    • Allow for a records review and reinstatement following revocation for cheating;
    • Provide for license suspension or revocation for cheating based on LDE determination versus LEA employment action;
    • Provide for ongoing suspension of the license pending litigation; and
    • Update the actions the LDE should take regarding the certification status for an educator, who has committed an offense that warrants revocation but does not hold a Louisiana license. Actions include reporting to the National Association of State Directors of Teacher Education and Certification (NASDTEC), the national certification database for educators, as well as noting the LDE database.

Description: Policies governing the operating procedures of BESE are contained in Title 28, Part I, of the Louisiana Administrative Code. As part of regular compliance and management activities, a review of the BESE Code was conducted to identify any needed updates, technical edits, and revisions as a result of changes in practice/procedure, legislation, or other regulations. The Board approved revisions to the following sections of the BESE Code:
  • §503.  Advisory Councils - clarifies that proxies designated by persons serving on an advisory council shall not retain voting privileges and adjusts agenda timelines;
  • §1107.  Minimum Foundation Program - proposed revisions update the Minimum Foundation Program (MFP) membership definition related to the at-risk student count to ensure alignment with state law; and
  • §1303.  Rulemaking - proposed revisions are technical in nature.
